Welcome to SellyAgent! These Terms of Service (“Terms”) govern your access to and use of the SellyAgent platform (“Service”), owned and operated by SellyAgent, Inc. (“we,” “us,” or “our”).

By registering for, accessing, or using our platform, you agree to be bound by these Terms.

1. Eligibility

You must be a licensed real estate professional or authorized representative of a brokerage to use SellyAgent. You must be at least 18 years old and capable of forming a binding contract.

2. Platform Overview

SellyAgent provides tools for:

• Email marketing automation

• Social media marketing

• AI-assisted content creation

• IDX/MLS data integration (via CoreLogic Trestle)

• Agent websites and landing pages

Your use of these tools is subject to the limitations and licensing rules outlined in these Terms and by applicable MLSs.

3. MLS & IDX Data Use

You acknowledge and agree that:

• SellyAgent accesses MLS data through CoreLogic’s Trestle™ platform.

• You must have proper authorization (e.g., from your broker or MLS) to use any IDX or back-office data feeds.

• MLS data may only be used for authorized marketing and client servicing purposes.

• You may not redistribute, resell, or repurpose MLS data.

• Violating MLS rules or RESO/NAR standards may result in immediate suspension or termination of your account.

4. AI Content & Marketing Tools

SellyAgent includes AI-generated content (emails, captions, website copy, etc.). You are responsible for:

• Reviewing all AI-generated content before publishing

• Ensuring accuracy, compliance, and adherence to your brokerage or MLS marketing rules

• Avoiding discriminatory, misleading, or illegal language

5. Account Security

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately of any unauthorized use or security breach.

6. Prohibited Uses

You may not:

• Use the platform for spam or unsolicited marketing

• Share MLS data with unauthorized parties

• Attempt to reverse-engineer or disrupt SellyAgent services

• Use automation to extract data or abuse platform resources

7. Intellectual Property

All content, designs, code, and features provided by SellyAgent are the intellectual property of SellyAgent, Inc. You may not copy, distribute, or create derivative works without permission.

8. Subscription & Billing

Some SellyAgent features require a paid subscription. By subscribing:

• You authorize recurring billing unless canceled before your next billing cycle

• No refunds are provided for unused time unless required by law

• You may cancel your plan anytime through your dashboard

9. Suspension & Termination

We reserve the right to suspend or terminate your access if:

• You violate these Terms

• You misuse MLS data or violate licensing agreements

• We receive notice from Trestle, your MLS, or your broker of a compliance issue

10. Disclaimers & Liability

SellyAgent is provided “as-is” without warranties of any kind. We do not guarantee:

• Accuracy or completeness of MLS data

• That marketing results will meet your expectations

We are not liable for any indirect, incidental, or consequential damages, including lost leads or revenue.

11. Modifications

We may update these Terms periodically. Changes will be posted on this page with a revised effective date. Continued use after changes means you accept the new Terms.

13. Security & Compliance

SellyAgent is committed to maintaining a secure and compliant platform for all users and data partners.

• Authentication & Access Control
  All access to the SellyAgent platform and MLS data is secured using OAuth2 token-based authentication.

• Data Protection
  We use encryption protocols to protect all data in transit and at rest, including user account information and MLS listing data.

• MLS & Industry Compliance
  SellyAgent adheres to:

  • National Association of REALTORS® (NAR) MLS data policy

  • RESO (Real Estate Standards Organization) compliance standards

  • CoreLogic Trestle™ licensing and usage guidelines

• Authorized Use Only
  We do not sell, resell, or redistribute MLS data. Data access is restricted to authorized, verified users for the sole purpose of real estate marketing and lead generation as permitted by their broker and MLS.

We monitor the platform for unauthorized activity and may suspend or terminate access for any violations of data security or compliance rules.
